The Florida maker of 37mm launchers lays out the federal rules in plain language as more Americans ask whether they can legally buy an M79 or M203 style launcher.
WINTER GARDEN, FL, October 30, 2026: Exotic Ammo, a veteran-owned U.S. maker of 37mm launchers and signaling rounds, today released a plain-language guide to a question it hears every day: can a civilian in the United States legally own a grenade launcher?
The short answer, according to the company, depends on two things: the caliber of the launcher and the rounds kept with it.
The key facts
-
40mm launchers are destructive devices. Military grenade launchers such as the M79, M203 and M320 are 40mm. Under the National Firearms Act (NFA), a 40mm grenade launcher is a destructive device. A civilian can only own one after registering it with the ATF and paying the federal tax, where state law allows it. Live high-explosive 40mm rounds must each be registered as well.
-
37mm launchers used for signaling are not regulated as firearms. Under federal law, a 37mm launcher used only with signaling rounds, such as flares and smoke, is generally treated as a signaling device. No special federal license is needed to buy one.
-
The rounds matter. The ATF has ruled that owning a 37mm launcher together with anti-personnel ammunition, such as rubber baton or bean bag rounds, makes it a destructive device.
-
There is a powder limit. Each 37mm round can contain no more than 109 grains of gunpowder in total, counting the lift charge and the payload.
-
State and local laws vary. Buyers should always check the rules where they live.
“People see an M79 or an M203 in a movie or a museum and ask us if they can own one,” said Tim Symons, CEO of Exotic Ammo. “The honest answer is that a real 40mm launcher is a destructive device and needs federal registration. A 37mm launcher is a different thing. It is built for signaling, it fires flares and smoke, and for most Americans it is the legal way to own that piece of history. We want people to know exactly where that line is.”
Exotic Ammo builds 37mm launchers in the styles people recognize: M79-style top break launchers such as the Tac-m79, and M203-style underbarrel launchers such as the m203, Tac-D and Pivot, which mount on AR-15 style rifles. The company also makes the Tac-79 and Tac-79P, which received U.S. Coast Guard approval in November 2025 for maritime distress signaling.
“Most of our customers are boaters, collectors, range shooters and people who simply want a dependable signaling device,” said Nicole Leith, Director of Marketing at Exotic Ammo. “Our job is to make the products well, here in the USA, and to be clear about the law so our customers stay on the right side of it.”
The full guide, covering the history of the grenade launcher, the main types, 37mm vs 40mm, and the legal rules, is available on the Exotic Ammo website. Customers can also browse the company’s full range of 37mm launchers and rounds at www.exoticammo.com.
